Simplified Visitor Parking Rules
Please be advised that the Boards have made an amendment to the Rules respecting the new Visitor Parking Rules for The East Market Phases 1, 2 & 3. The new Rules were passed by resolution of the Boards at a meeting of the Boards held on August 7, 2008. Copies of the new rule are attached to this notice. The reason for updating the Rules is to simplify the wording and avoid any confusion. Please be advised that they don’t represent any substantial change from the visitor parking policy that is already being enforced today.
The following Rules respecting the use of the common elements and units are made to promote the safety, security and welfare of the owners and of the property, aesthetics of the building and for the purpose of preventing unreasonable interference with the use and enjoyment of the common elements and of other units. All previous Visitor Parking Rules are hereby repealed.
The Rules of the Corporation are binding on each unit owner/resident and his or her family, visitors, servants, agents or occupants of the unit.
The Corporation may pass additional Rules from time to time in accordance with the Condominium Act, 1998.
The Board of Directors are responsible to establish rules and regulations and any amendments thereof. Please note that they may alter these generic rules as they see fit to accommodate the needs of The East Market Phases 1, 2 & 3 and its residents.
The new rules will become effective thirty (30) days after the Board has given notice to the owners unless the Board receives, within those thirty (30) days, a requisition from the owners of 15% of the units (in accordance with Section 46 of the Condominium Act) for a meeting to consider the proposed rules. If a requisition is received within those thirty days, the requisitioned meeting will be called and the Rules will then be effective only if the owners approve the rules at that meeting of owners.
The Boards proposes that the new Rules will become effective on September 24, 2008, (30 days after this notice is given to the owners).
We trust the attached meets the approval of the owners of the East Market Condominiums.
14. VISITOR PARKING
PERMITTED USE OF VISITOR PARKING
(a) Only visitors of residents: Visitor parking is only to be used by visitors of residents of The East Market. No owner or tenant may park in the visitor parking at any time. No worker, employee and/or customer of the retail units of The East Market, may park in visitor parking at any time.
(b) General parking rules apply: Note that section 9 of the Rules & Regulations, pertaining to parking in general, also pertains to visitor parking.
SHORT-TERM SPACES
(c) Three hours, no registration: Visitors may park on a short-term basis for a maximum of three (3) hours ONLY in the designated short-term parking spots, without registering.
Registered vehicles shall not park in short-term parking spots.
REGULAR SPACES
(d) Limit to 3 out of 7 days: Visitors may park in regular visitor spaces, on a maximum of three (3) calendar days within a seven (7) day period. The seven (7) day period begins on the first day the vehicle is parked.
(e) Must register: The resident must register the vehicle of any visitor using a regular space. The procedure for registering a vehicle is published on theeastmarket.ca website, and is also available from the Property Manager.
ENFORCEMENT
(f) Ticketing / towing: Any vehicle parked in contravention of these rules may be ticketed and/or towed at the expense of the vehicle owner.
